A recent legal battle over Buffalo Wild Wings' boneless wings has sparked a heated debate, with an Illinois judge ruling that the lawsuit had "no meat on its bones." This controversy revolves around the use of the term "boneless wings" and whether it misleads customers.
In 2023, Aimen Halim took legal action against the restaurant chain, arguing that the name "boneless wings" is deceptive as it contains chicken breast meat instead of traditional wing meat. Halim's experience at an Illinois location in January 2023 led him to believe he was ordering deboned wings, but he was surprised to find out otherwise.
Halim's argument was that had he known the truth, he would have either refused the purchase or paid less. He sought monetary damages to compensate for this alleged deception.
However, Judge John Tharp Jr. of the U.S. District Court for the Northern District of Illinois disagreed. In his opinion, Tharp stated that the term "boneless wings" is not misleading but rather a creative name. He highlighted that words can have multiple meanings, using the example of "buffalo wing" to explain that the term might refer to the sauce rather than the meat source.
Tharp further explained that a reasonable consumer would not assume that Buffalo Wild Wings' boneless wings are made from deboned chicken wings, especially considering the existence of similar products like cauliflower wings. He emphasized that the term "boneless wings" has been in common use for over two decades and is well-known to customers.
Buffalo Wild Wings also defended its use of the term, stating that reasonable consumers would not be misled, as context clues indicate that the product cannot be made from wing meat.
The restaurant chain and Halim's legal team have not yet responded to requests for comment. Judge Tharp gave Halim until March 20 to file an amended complaint, leaving the door open for further legal action.
